Step 6: Final Judgement

If the judge approves a summary judgement, or if the judge rules in favor of the lender at trial, a final judgement of foreclosure is entered. The judge then authorizes the Clerk of the Court to set a public auction date. Per Florida statute, the court has between 20 and 35 days after the filing of final judgement to set an auction date.

Final judgement is when matters can become rather difficult for homeowners. After final judgement, you have officially lost the case. However, you still technically own your home, and you still have the right to redeem your property under Florida’s right of redemption laws. Under these laws, you have the right to bring your defaulted mortgage current to include late fees and penalties and officially keep your house.
